Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS (TERMS) BEFORE USING THE SERVICES. By registering for an account and/or purchasing a Premium Membership, you acknowledge that you have read and understood these Terms, and you are in agreement with them. 

You will refer to Adult Users (as defined below) of the Services and purchasers of a Premium Membership. 

Adult is a person of legal age who can enter into this contract by registering a membership and/or purchasing a Premium Membership. You represent and warrant that you are an adult and you are responsible for ensuring that any child or student authorized by you to use and access the Services does so in accordance with these Terms. 

Premium Membership will refer to a paid membership to the Services.

Services will refer to the website, apps, all content accessible on the website, online games, and including but not limited to, teaching resources.

Registration Information refers to the User’s username, password, and other information used during registration to the Site.

Users refer to Parent User, Educator User, and Child User.

Account Types

We currently offer three types of accounts through our services: Child Account, Parent (or Legal Guardian) Account, Educator Account.

  1. Child Account (Child User)
    A Child User may only be created by the Parent User. A Child User will have access to their account using a unique username/password combination provided by the Parent User.
  2. Parent (or Legal Guardian) Account (Parent User)
    A Parent User is an Adult and may register with an email address. A Parent User may create an account for his/her child or children.
  3. Educator Account (Educator User/Teacher User)
    An Educator account may be registered by an Adult currently employed by a school, school district, licensed childcare facility or other educational institution/program.


Registration

You are required to provide accurate and complete information when registering to use the Services. You must not provide false or misleading information to create an account. You must not create an account for anyone other than yourself and your child/children. If you are signing up for a Parent Account or Educator Account, you certify that you are 18 years of age or older. You agree that your information will be updated to keep it current at all times. MoneyPrep reserves the right to refuse registration at its discretion. You are responsible for keeping your username and password confidential and strictly prohibited from sharing this information with anyone else. You may not transfer your account to a third-party. You may not share your Registration Information with any third party.

Online Learning Game

The online learning game allows user to play multiple different challenges. The user earns virtual coins as they navigate the world and play the challenges. The virtual coins cannot be exchanged for real money. The virtual coins are only used within the learning game.

Membership and Premium Membership Fees

Premium Membership Fee. The basic version of the Services are provided for free. A premium version of the Services is available for access with a paid Premium Membership. By purchasing a Premium Membership, you agree to authorize MoneyPrep to charge you the associated membership fee – on a monthly, six-month, annual basis, or group packages (for Educator) – depending on your selected Premium Membership. All fees will be subject to applicable taxes. You agree that we may renew your Premium Membership automatically for the same Premium Membership term at the end of each previous Premium Membership term (monthly, six-month, annual). The prices for Premium Memberships and other charges may change without notice. The Premium Membership begins from the date of purchase to the date of cancellation or expiration of the term. Premium Memberships or free memberships cannot be transferred or assigned to a third-party. A third-party must not be granted access to the Services through your Registration Information.

Premium Membership Cancellation. You may cancel the Premium Membership prior to its renewal date through the Parent/Educator Dashboard or by contacting our Customer Support Team. In the case of Premium group packages purchased through the Educator account, these will expire at the end of the term. You will have access to the account until the end of the Premium Membership period. Please be aware that we do not provide full or partial refunds for prepaid Premium Memberships.

Service Ownership and License

The Services are owned and controlled by MoneyPrep Inc. and protected by international copyright, trademark, patent, and other intellectual property rights and laws to the fullest extent. You agree not to copy, reproduce, reverse-engineer, create derivative works, disassemble, change, modify, or do anything to exploit in any other way the Services. The purchase of a subscription is a non-transferable license (License) to use the Services for the subscription term. The License does not grant you any ownership rights.

Termination

MoneyPrep has the right to terminate your account at any time upon failure to comply with the terms found here in Terms and Conditions. MoneyPrep reserves the right to terminate access to the Services without prior notice. MoneyPrep shall not be liable to you or any third-party in the event of termination.

Privacy

We take your privacy seriously and make best efforts to limit the information we collect. Please read our Privacy Policy for more details.

Disclaimer of Warranties

The Services are provided on an “as is”, and “as available” basis and without warranty of any kind, express or implied. No warranty, representation, endorsement, or promise is made to the following, but not limited to:

  1. The Services;
  2. Functionality, features, or other elements made available through the Services;
  3. Any products or services linked to the Services;
  4. Whether the Services are available, error-free, free from harmful components;
  5. Specific availability of the Services, and whether any defects will be repaired in a certain time period and, but not limited to;
  6. Whether your use of the Services is lawful in any particular jurisdiction.


Limitation of Liabilities

MoneyPrep Inc shall not be liable for any direct, indirect, incidental, special or consequential damages including but not limited to personal injury, property damages, lost profits, loss of data or intangible losses, even if we have been advised of the possibility of such damages, resulting from:

  1. The use of or inability to use the Services;
  2. The conduct or actions of any User of the Services;
  3. Unauthorized access to or alteration of your data;
  4. any other matter relating to the Services.
  5. In no event shall our total liability to you for all damages, losses, or any other claims related to the Services whether in contract, tort, or otherwise exceed the amount paid by you, if any, or $50, whichever is less.


Indemnity

You agree to indemnify and hold harmless MoneyPrep Inc, its affiliates, officers, successors and assigns, distributors, or other persons, authorized users, all shareholders, directors, owners, employees, and agents from all third party claims, demands, losses, liabilities and costs, including reasonable attorneys’ fees, through your use of the Services, any breach by you of the Terms and Conditions arising out of your use of the Services, or your violation of any rights of another.

The Services may provide links to third-party websites or resources. We make no representations or warranties of any kind regarding the quality, availability, or legality of these external sites. MoneyPrep is not responsible for any third-party website or resources contained outside of the MoneyPrep Services.

Severability

If any term or provision of the Terms and Conditions is held to be void or unenforceable, that term or provision shall be severed from the Terms and Conditions. The balance of the Terms and Conditions will survive and will be reasonably construed to carry out the intent of the parties as evidenced by the terms of the Terms and Conditions.

Governing Law

The Terms and Conditions shall be governed by the laws of the Province of Alberta and the jurisdiction of the Courts of the Province of Alberta.

Assignment

We reserve the right to assign our rights and obligations under the Terms and Conditions, or any additional terms, in whole or in part, to any party at any time without prior notice.

Entire Agreement

The Terms set out here constitute the entire understanding and agreement  between you and MoneyPrep Inc with respect to the subject matter of the Terms and Conditions. There are no agreements, restrictions, representations, understandings, and warranties other than those expressly outlined in the Terms and Conditions
